Can I take legal actionagainst Phy??? Yet more ACL problems

I'll try and keep this short and sweet...
I had an ACL Recon with BUPA in January this year.
About 3/4 weeks post op the Physio more or less told me to stop walking with crutches and to stop walking with a limp and straighten my leg.

I went home and tried this and within a minute or so my "bad" leg kinda give way and jerked back. There was no pain, no snapping noise and no other sensation, but i feared my ligament had gone....

Fast forward to today and 10 months post op, Last night my NHS consulatant did the Lachman test and my knee was popping every time he did it. He said it is still unstable and confirmed my fears which I had had for the last few months. Im going for an MRI scan.... when they can book me in and it looks like im back to square one, with my life savings gone.

The question is - Is any legal action against BUPA likely to be succsesful. Personally I think its going to be very difficult to prove that the advice given at that time casued the ligament to go. As I say I cant be 100% that it did re-reupture during my stumble(even if it has) --- plus there are many other factors which could have caused a failure. poor graft. loose screws etc.

My NHS consultant told me 3 or 4 times there is NO way he would help me if I wanted to take any legal action against the BUPA consultant as it would "damage his own reputation". Nice guys these GP's :( ...

At the moment I dont think I could go through surgery and rehab again, with part of my good leg "cut" away for another graft. At the moment Rehab is going well , No giving way or pain during running, but then I was like that before surgery. At 24 I think my footballing days may well be over :cry:

Forget the lawsuit - they just create a worse mess. Concentrate on recovering your knee. Your footballing days are NOT over. For one thing, if you need to reconstruct again, you can use a cadaver graft as a last resort. I know plenty of people who have had full recoveries on cadaver grafts. I know it sounds gruesome, but it does work. You can get through surgery and rehab again - just think of the footballing ahead of you. Just push forward as fast as you can - the sooner teh better. good luck!
